Affidavits in mississauga

Similar to a statutory declaration, an affidavit is a series of statements sworn under oath declaring to be true. They are used for a variety of purposes, predominantly in court proceedings. In a court of law, civil or criminal, affidavits have evidentiary value.

All affidavits identify the affiant, declare that the statements stated are true before stating the facts. They are then signed by the affiant or the affiants together, in the presence of a notary public or a commissioner of oaths duly appointed.

The basic requisite for making an affidavit are that the person should be of sound mind and above the age of 18 along with having personal knowledge of the facts.

Evidences or other documents in support of the affidavit are added as exhibits to statutory declarations.

One important caution to be considered in executing an affidavit is that under the Canada Evidence Act and Criminal Code, false declaration or statements are charged with perjury and punished with imprisonment up to 14 years upon conviction.
