A custodianship declaration or a child custody declaration is a document that supports a person’s claim to the custody or decision-making responsibility over a child or children. The document will usually include the names of the parties involved including the children, their dates of births, contact information and other information as required.
It is a form of declaration executed in the presence of a notary public or a commissioner of oaths duly appointed.
It is important to note that legal custody and physical custody different. It is possible for one parent to have legal custody (decision-making responsibility) while the other parent has physical custody. If the parents cannot mutually agree, a court’s role is required to decide on the decision-making responsibility and reasonable access by the parents, considering the best interest of the child.
