Sexual Assault
Section 265 Criminal Code that deals with assault addresses sexual assault (violation of a person’s sexual integrity without consent) as well. The offender does not necessarily have to have a sexual purpose or an intention to receive sexual pleasure from his act. A mere violation of the victim’s sexual integrity is sufficient to constitute violence under this section.
Sexual assault attracts a maximum penalty of ten (10) years of imprisonment. Consent plays a major role in this charge to the extent that non-consensual sexual relationship between even spouses is a crime. Consent and honest but mistaken belief in consent (free of recklessness or wilful blindness) are two common defences available in sexual assault charges.
