The provincial legislation had empowered Notary publics and Commissioner of Oaths to administer and witness the swearing of Oaths, solemn declarations or affirmations in the form of affidavits. The affirmations or declarations must be duly administered yet they do not certify the truth of the contents.
In most cases, the deponent is physically required to be present before the commissioner to satisfy the identification and verification purposes, however, this process can be done remotely and electronically.
A lawyer licensed by the Law Society of Ontario and a Notary Public can act as a commissioner of oaths.
